Launch terms, conditions and regulations

  1. The Permit Holder,
    • Must launch their craft only in the designated area at the south side of Cullercoats Bay.
    • Must observe the speed limit at all times whilst using the harbour entrance, in both directions, and whilst using the beach to turn around.
    • Must launch and beach within the designated zones. The zone at North Longsands, Tynemouth may only be used for the beaching of craft and a 5 mph speed limit must be observed at all times.
    • Must not park on, or obstruct in any other way, the ramp or access to the beach.
    • Must leave trailers in a safe location (area between Pier and Launch ramp)
    • not obstructing any line of passage for people launching or preventing
    • access for emergency vehicles.
    • Must at all times observe and obey The Byelaws which state that ‘ motorised craft shall not proceed at a speed exceeding 5 miles per hour while within 440 yards of the low water mark of ordinary tides opposite the sea shore.
    • Must at all times carry a minimum of £1 million indemnity valid Third Party Insurance and the permit holder hereby agrees to indemnify North Tyneside Council, or its agents, against all claims, actions, demands, injuries, costs, charges, expenses and liabilities which may be incurred by the Council, or its agents, as a result as granting the permit on the exercise of any right thereunder.
    • Must produce their permit to any authorised officer of the Council, or agent of the Council, when called upon to do so.
    • The craft registration sticker(s) must be on display in a prominent position at all times to allow ease of identification on the water.
  2. If at any time the Permit Holder fails to comply with any of the conditions hereof this permit shall be revoked forthwith without notice and without refund of the ticket fee or any part thereof and the decision of the Council, or its agent, shall be final in this respect.
  3. Any Permit Holder who engages in behaviour causing or likely to cause a nuisance or annoyance to other sea / beach users or who encourages or instigates others to do so, will have their Permit revoked and will be prohibited from any future use of the site for a minimum of two years at the discretion of the Council, or its agent. Persistent nuisance behaviour may lead to legal action being taken which could include the imposition of an Antisocial Behaviour Order.
  4. Breach of an ASBO is a criminal offence and carries a maximum of five years imprisonment and / or a £2,000 fine. Information on offenders will be passed to neighbouring authorities to assist in the control of nuisance or annoying behaviour.
  5. The permit shall remain in force for the period stated, unless determined by one week’s written notice served at any time by the Council, or its agent, on the Permit Holder at the address shown on the permit. Upon such determination the Council, or it’s agent shall refund an appropriate proportion of the permit fee having regard to the period of the permit when expired.
  6. The benefit of the permit is personal to the Permit Holder and relates only to the craft named on the launch permit application. It may, with the consent of the Council, or its agent, be exercised in relation to that craft by persons acting at the request or with the authority of the Permit Holder, (who will nonetheless remain liable hereunder for their acts or omissions ) but may not be transferred or assigned.
  7. The Permit Holder must ensure the barrier is closed after use to prevent unauthorised use of the site. Any Permit Holder found to be disregarding this condition will be asked to return their key and permit immediately.
  8. The key and permit must be returned when requested by the Council,or its agent.
  9. No person under the age of 12 should use a Personal Watercraft. Persons aged between 12 and 16 may use a Personal Watercraft but only under direct supervision of an adult.
  10. “Driving motors etc. – no person shall on the sea-shore , propel or drive any motor car, motor cycle to the danger of any person using the sea-shore.” ( Public Bathing Byelaws – Tynemouth, effective 01.06.1937 ). Any persons found to be in breach of the above byelaw will have their permit revoked immediately.
  11. Motorised leisure craft includes, but is not limited to the following :-
    - Personnel Watercraft/Speed Boats/Leisure Craft.
  12. The number of Personal Watercraft users shall be limited to no more than twenty users at any one time.

Enforcement of the Regulations will be carried out by officers of the Council, its agents, the Police and assisted by other Maritime agencies.
